Terms of service.

By using Creator Chat you agree to the following terms.

1. Contracting parties & scope

These Terms of Service govern your use of the Creator Chat platform (the "Service") provided by Creator Chat ("we", "us", "our"), operated by the entity identified in our Imprint. By signing up, accessing or using the Service, you (the "User") accept these terms in full.

These terms apply to all users — solo creators, agency admins, and team agents — across every plan, including the free tier.

2. The service we provide

Creator Chat is a Telegram CRM and integration layer. It allows authorised users to:

• Connect and manage one or more Telegram accounts in a single interface — both Telegram Bot accounts and, where you choose to, Telegram user ("Enduser") accounts connected via your own phone number / login session
• Assign team members (agents) to specific creator accounts with role-based permissions
• Connect a Fangate account to view vault data and send PPV sale links directly inside chats
• Use AI-assisted reply suggestions and similar productivity features (see Section 6)
• Track sales activity, conversion and chat performance

Creator Chat is an integration layer. We do not provide payment processing, content hosting, content moderation, or the underlying Telegram, Fangate or AI services themselves.

3. Account, registration & eligibility

To use the Service you must:

• Be at least 18 years old
• Provide accurate registration information (work email, agency name, etc.)
• Keep your password and 2FA credentials confidential
• Be responsible for all activity that occurs under your account

You agree to notify us immediately at info@creator-chat.com if you suspect unauthorised access to your account.

4. Connecting third-party accounts (authorisation & credentials)

To use core features you connect third-party accounts — Telegram (Bot or user account) and, optionally, Fangate. By connecting such an account, you:

• Authorise Creator Chat to access and act on that account on your behalf, to the extent required to provide the Service (e.g. sending and receiving messages, reading vault and sales data).
• Confirm that you are entitled to connect it and that doing so does not breach any agreement you have with Telegram, Fangate or any third party.
• Acknowledge that the relevant credentials (e.g. your Telegram login session, your Fangate API token) are stored encrypted, but that you remain responsible for keeping the underlying accounts secure and for the consequences of connecting them.

You may disconnect or revoke access at any time in your settings. Revocation may disable the features that depend on the connected account.

5. Telegram account risk & automation

You acknowledge and accept that:

• Connecting and operating a Telegram account — and in particular a Telegram user account — through the Service is done at your own risk.
• Telegram may restrict, rate-limit, "flood-wait", suspend or permanently ban any connected account at any time, for any reason, and without notice.
• Safety mechanisms we provide (for example reply-only sending, rate pacing and staggered connection) reduce but do not eliminate this risk and are not a guarantee against bans or restrictions.
• We are not liable for the loss of, restrictions on, or any data associated with a connected Telegram account — including lost chats, contacts, messages or revenue — resulting from a ban, restriction or any action by Telegram.
• You are solely responsible for complying with Telegram's Terms of Service, Bot API rules, and anti-spam and automation policies.

6. AI-assisted features

The Service may offer AI-assisted features, such as reply suggestions, powered by third-party AI providers (for example OpenAI). Where you use these features:

• AI output is a suggestion only. You must review every suggestion before sending, and you remain solely responsible for all messages actually sent through your connected accounts.
• AI output may be inaccurate, incomplete, inappropriate or contextually wrong. We make no warranty as to its accuracy, suitability or compliance with any law or platform rule.
• To generate suggestions, relevant conversation content is transmitted to and processed by the third-party AI provider under their terms. See our Privacy Policy and our data-processing terms (Section 11).
• You must not rely on AI output for legal, medical, financial or other safety-critical decisions.

7. Pricing & future paid plans

The Service is currently offered free of charge with full access to all features. No credit card is required and no time limit applies.

We reserve the right to introduce paid plans in the future. If we do so, we will give existing users at least 14 days' notice before any charges apply — for example by email or by an in-app notice or consent prompt. You will retain the option to continue on a free tier (if offered) or to cancel without penalty.

8. User obligations & permitted use

You agree to:

• Use the Service only for its intended purpose — managing legitimate Telegram chats and PPV sales for an adult-oriented business operating within the laws of your jurisdiction.
• Comply with Telegram's Terms of Service and Bot API rules, and with Fangate's Terms of Service if you connect a Fangate account.
• Be solely responsible for the content sent through your connected Telegram accounts (including content sent by your agents).
• Ensure that all real people depicted in any content you sell are adults, have given informed, documented consent, and that you hold and retain the necessary rights, age-verification and consent records — and produce them on lawful request.
• Be solely responsible for taxes, invoicing, and the legal status of your business in your country.

9. Prohibited content & behaviour

You may not use the Service to:

• Produce, distribute, sell or solicit any sexual content involving minors (CSAM). This is illegal globally and will be reported to the relevant authorities.
• Engage in human trafficking, coercion, or non-consensual content of any kind.
• Distribute content where the depicted person has not given informed, documented consent.
• Send malware, phishing links, spam, or any unsolicited bulk messages outside the boundaries of legitimate creator-fan interaction.
• Circumvent Telegram's anti-spam, anti-abuse or rate-limit measures.
• Attempt to reverse engineer, hack, or otherwise compromise the Service.
• Use the Service in a sanctioned jurisdiction or in any way that violates applicable export controls.

We reserve the right to suspend or terminate any account that violates these rules without prior notice.

10. Agencies, creators & agents

The Service supports an agency model in which an account holder manages one or more creators and assigns agents to handle their chats. Where you use the Service in this way:

• You confirm that you are authorised by each creator to manage their connected accounts and to assign agents to them.
• The account holder (agency) is responsible for the acts and omissions of all agents it invites, and for ensuring agents only access the accounts they are authorised for.
• Agents act on behalf of the creator/agency; role-based permissions govern what each agent can see and do.
• You are responsible for managing access when relationships change (e.g. removing an agent, or disconnecting an account). We provide tools for this, but we do not police your internal arrangements between agencies, creators and agents.

11. Data protection & data processing

In operating the Service, Creator Chat processes personal data of your fans and contacts — for example messages, usernames, contact details and purchase information — on your behalf and on your instructions.

• For this processing, you act as the data controller and Creator Chat acts as the data processor within the meaning of Art. 4 and Art. 28 GDPR.
• This processing is governed by a Data Processing Agreement (DPA) in accordance with Art. 28 GDPR, which forms part of these Terms and is available on request and referenced in our Privacy Policy.
• You are responsible for having a valid legal basis to process your fans' personal data, and for informing them as required by applicable data-protection law.
• What we store, where it is hosted, and for how long, is set out in our Privacy Policy.

12. Intellectual property & licence

Creator Chat — including its software, design, interface, trademarks, logos and all related intellectual property — is and remains the property of Creator Chat or its licensors. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose for the duration of your use.

You retain all rights to your own content. You grant us a limited licence to host, store, process and transmit your content and your connected-account data solely to operate and provide the Service to you.

You may not copy, resell, sublicense, frame, scrape, reverse engineer, or create derivative works of the Service, except where such restriction is prohibited by mandatory law.

13. Warranties & disclaimers

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied — including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or that the Service will prevent account bans, message non-delivery, data loss or any specific business result.

Mandatory statutory warranty and consumer-protection rights — in particular under German law — remain unaffected by this section.

14. Limitation of liability

To the maximum extent permitted by law, Creator Chat excludes all liability for:

Fangate-related issues

• Outages, downtime, latency or errors on the Fangate platform or its API
• Incorrect balance, payout, or transaction data shown to you (which we fetch from Fangate as-is)
• Suspension, banning or content moderation decisions made by Fangate against your account
• Delays in payouts or failed transfers caused by Fangate's payment partners
• Changes to Fangate's pricing, terms, or feature set

Telegram-related issues

• Bot or user account bans, rate limiting, or restrictions imposed by Telegram (see also Section 5)
• Changes to the Telegram Bot API or protocol that affect Creator Chat's functionality
• Telegram's own content moderation decisions
• Message deliverability or arrival timing

AI-related issues

• The accuracy, suitability or consequences of AI-generated suggestions you choose to send
• Outages, errors or changes on the third-party AI provider's side

Server & infrastructure issues

• Downtime caused by our hosting provider, internet routing, DDoS attacks, or force majeure events
• Data loss caused by third-party infrastructure failures beyond our control (we operate our own backup processes — see Privacy Policy)
• Performance degradation due to peak load or scheduled maintenance

Indirect & consequential losses

• Lost revenue, missed sales, or business opportunity costs arising from any of the above
• Damage to your reputation or relationships with fans, agents or partners

Our liability is limited as follows: for damages caused by simple negligence, our liability is limited to the foreseeable damages typical for this type of contract. We accept full liability only for damages caused by our intent or gross negligence, for personal injury, and where mandatory law requires (e.g. the German Produkthaftungsgesetz). Subject to these mandatory exceptions, and to the extent permitted by law, our total aggregate liability for any claim is limited to the total fees you paid to us in the twelve (12) months before the event giving rise to the claim, or — for free-tier users, for whom the Service is provided at no charge — to EUR 100.

15. Indemnification

To the extent permitted by law, you agree to indemnify, defend and hold harmless Creator Chat, its operators and staff against any third-party claims, damages, losses, liabilities and reasonable costs (including reasonable legal fees) arising out of or related to:

• the content you produce, send or sell through your connected accounts;
• your breach of these Terms or of any applicable law;
• your infringement of any third party's rights — including the rights of depicted persons, intellectual-property rights, and data-protection rights;
• your use of, or the loss or restriction of, any connected Telegram, Fangate or AI account; and
• claims raised by your fans, agents or the creators you manage.

This obligation does not apply to the extent a claim results directly from our own intent or gross negligence.

16. Service availability

We aim for high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will normally be announced in advance. Unplanned downtime may occur and does not entitle you to compensation or refund (especially given the free nature of the current Service).

17. Termination & account deletion

You may terminate your use of the Service at any time by deleting your account in the settings or by emailing info@creator-chat.com. Upon deletion, your account data will be removed in line with the retention periods set out in our Privacy Policy, and your connected Telegram and Fangate accounts will be disconnected.

We may terminate or suspend your account if you violate these Terms, if required by law, or if we discontinue the Service entirely. We will provide reasonable notice except in cases of serious breach (see Prohibited content).

18. Changes to these terms

We may update these Terms from time to time to reflect changes in our Service, the law, or industry practice. Material changes will be announced to active users by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Governing law & jurisdiction

These Terms are governed by the laws of Gibraltar, excluding conflict-of-law principles and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection rights of the user's country of residence remain unaffected.

The place of jurisdiction for any disputes arising from or in connection with these Terms is, where legally permitted, the courts of Gibraltar, the registered seat of Creator Chat Limited.

20. Final provisions

Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control — including third-party platform outages, internet or hosting failures, DDoS attacks, acts of God, war, strikes, or changes in law or regulation.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to a successor entity, for example in connection with a merger, acquisition or sale of assets.

Entire agreement

These Terms, together with our Privacy Policy and the Data Processing Agreement, constitute the entire agreement between you and Creator Chat regarding the Service and supersede any prior agreements on the same subject.

No waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.

Notices

We give notices by email to the address on your account. You can reach us at info@creator-chat.com.

Severability

Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the intended economic purpose.

Survival

Provisions that by their nature should survive termination — including those on liability, indemnification, intellectual property and governing law — remain in effect after your use of the Service ends.
